I must stress that I am not a lawyer, I don't think any of my fellow mods are lawyers, and so we can't say what is right legally. PMBD can be justified by saying that it's providing the bandwidth for free, so the items don't need to be pay and PMBD can distribute them at will. In the intervening 6 years, people have either taken liberty with that or ignored it altogether, and thus we have pay sites and pay-per-item sites, etc. Way back in the Sims 1 days, EA/Maxis did tell people that it was okay to charge for bandwidth, but not the custom content.

EA doesn't license you to sell derivatives of their intellectual property. That language states that, for the benefit of the community, you can create and offer derivative custom content ('materials') as long as you do so noncommercially you cannot sell the custom content because it's based off of and created by EA's intellectual property (in other words, because someone must use The Sims 2's objects/skins/code/whatever as a basis from which to create the custom content or mods, it's a "derivative"). The site explains why it exists, but to summarize:ĮA/Maxis make you agree to an End User License Agreement with a lot of legal language.

The people over at MATY, specifically JM Pescado, started Paysites Must Be Destroyed to share pay/donator items. This is going to be a wall of text, but just bear with me, ok? When we (mods) first became aware of PMBD, we knew we'd need to talk about it here, we just hadn't gotten to it yet. By now I'm sure almost all of you have seen munkimunki's entry about RoseSims and the alleged sharing of PayPal information.
